JAMES DAVID BOYD
This is the last will and testament
of me James David Boyd of the said island merchant. I direct my debt, funeral
and ..any expenses and also the legacies here- inafter given be ..paid
as soon as conveniently may be after my decease from and out of my personal
estate. I request my executors hereinafter named to accept a legacy of
twenty five pounds sterling each as an acknowledgment for the trouble they
will have in the execution of my said will. I give and bequeath the following
sums to the persons hereinafter mentioned that is to say: To my friend
William Dubisson of the said island goldsmith the sum of ?? pounds Sterling.
To my godson Charles Robinson the son of William Robinson the sum of five
pounds Sterling. to ?? Thinsteat of the said island the sum of twenty pounds
Sterling. I give and bequeath to Miss Mary Thompson my silver watch and
gold chain with the gold ring thereto attached which I request her to accept
as a token of my friendship and regard for her. I give and bequeath to
Mrs Redhead the widow of my late friend the Honorable William Redhead as
a token in remembrance of her late husband's kindness to me my gold ring
with Coinelian Stone bearing my initials thereon. I desire that all my
real estate lands and ?? and also all my household furniture (save and
except my ??) shall be sold and disposed of and converted into money and
the proceeds of such sale to form part of my general funds. I give and
bequeath my Prefs unto my reputed son Theodore David Boyd. Whereas I have
for sometime past carried on the business of a merchant in this island
and I am desirous that the same business shall be carried on after my decease
for the benefit of my said reputed son Theodore David Boyd. Now therefore
I give and bequeath my said business and all my stock in trade and effects
and all monies and debts which shall belong and be due and owing to me
at the time of my decease. And also all monies which I may have in the
hands of Mr George H. Penny of Lime Street, London and all monies in the
Colonial Bank in the island belonging to me at the time of my decease unto
my friends James Alexander Garraway, Henry Augustus Signoret and Edward
Sheriff Dauberry all of the said island esquires their executors, administrators
and assigns upon trust that the said trustees or trustee for the time being
of my will do and shall carry on manage and conduct my said business until
my said reputed son Theodore David Boyd shall attain the age of twenty
one years and I declare that during such times as the said business
shall be carried on by the said trustees or trustee in persuaance of this
my will they and he shall stand and be possessed of and interested in the
said business stock effects monies and debts and the profits to arise from
the same upon and for the trusts interests and purposes of this my will,
provided always that if the said trustees or trustee for the time being
of this my will shall deem it necessary or expedient so to do, they or
he shall be at liberty to discontinue my said business and shall sell and
dispose of the stock and effects therof and do and shall stand and be possessed
of the monies arising from such sale upon and for the trusts intent purposes
of this my will. And I further declare that if my said reputed son Theodore
David Boyd shall live to attain the age of twenty one years then I direct
the said trustees or trustee to put my said reputed son Theodore David
Boyd into the full and complete possession of my said business, trade or
concerns and all the stock and monies aforesaid with all interest profit
and produce thereof and all monies arising from the sale thereof together
with all interests thereon and to assign and makeover unto him all securities
for money debt, goods and effects of my said business trade or concerns.
And I direct that in the meantime and until the vesting and payment of
the said legacy and monies hereby provided for my said reputed son Theodore
David Boyd the said trustes or trustee shall and will by with and out of
the interest produce and profits of the said monies, stock business and
effects raise and pay such sum and sums of money as they or he shall think
proper for or towards the maintenance, education and support of my said
reputed son. And it is my express desire that my said reputed son shall
not frequent or hold any communication with his mother and he shall be
under the immediate care, control and supervision of my said trustees or
trustee provided always that if my said reputed son shall die under the
age of twenty one years without leaving issue then I direct that my said
trustees and trustee shall and will discontinue my said business and shall
sell and dispose of the stock and effects thereof and shall pay and apply
the proceeds arising from such sale together with all other monies which
I may die possessed of in manner following that is to say: the said
trustees or trustee shall keep and retain for themselves or himself the
further sum of twenty five pounds Sterling each and the balance shall be
paid to the managers, trustees or other person having the care control
or management of the Roseau Infirmary to be applied towards the purposes
of that institution to and for the use and benefit of the inmates thereof.
I hereby nominate and appoint the said James Alexander Garraway, Henry
Augustus Signoiet and Edward Sheriff Dawbinney the executors of this my
will hereby revoking all former and other wills by me at any time heretofore
made.
